1. Eligibility: The American Hardcore Premiere Sweepstakes (“Promotion”) is open only to current legal residents who are
physically located and residing within 50 miles of the cities of Boston, MA,
Los Angeles, CA, New York, NY, and San Francisco, CA (‘Eligible Cities”),
and who are 21 years of age or older as of time of entry. Any individuals
who have, within the last six months, held employment with or performed services
for Sony Pictures Classics, Inc. (“Sponsor”), YouTube, Inc., Sony
Pictures Entertainment Inc., Sullivan Compliance Company, Skycastle Entertainment,
Inc., their advertising or promotion agencies, or any agency involved in the
production, development, implementation or handling of this Promotion, any
agents acting for, or on behalf of the above entities, their respective parent
companies, officers, directors, subsidiaries, affiliates, licensees, service
providers, prize suppliers, any other person or entity associated with this
Promotion (collectively “Promotion Entities”), and members of
their immediate families (spouses, children, siblings, parents), and/or persons
living in the same household as such persons, whether or not related, are
ineligible to enter this Promotion.
2. How to Enter: This Promotion consists of four (4) individual
nonconnective sweepstakes; each individual nonconnective sweepstakes represents
one of the four (4) Eligible Cities and each has its own entry period (see
Entry and Drawing Chart “Chart’ below). ENTRANTS CAN ONLY
ENTER THE INDIVIDUAL NONCONNECTIVE SWEEPSTAKES ASSOCIATED WITH THEIR RESPECTIVE
ELIGIBLE CITY OF RESIDENCE. To enter, access www.americanhardcoremovie.com (“Web
Site”) and follow the online instructions to complete and thereafter
submit the entry form (“Entry”). Information required on the entry
form includes: First Name, Last Name, Physical Address (P.O. Box addresses
are invalid), City, State, Zip, Daytime Telephone Number (including area code)
where entrant can be reached between 3:00 p.m. and 6:00 p.m. within entrant’s
respective time zone if determined a potential winner, Email Address, Date
of Birth, and Gender (collectively “Entry Information”). Limit
one (1) Entry per person/email address for the entire Promotion. Entries by
the same person in excess of this limit will be disqualified. Entries for
a particular individual nonconnective sweepstakes must be received by the
Entry End Date stated in the Chart below. All Entry Information must be completed
in full. Proof of delivery or receipt of an Entry will not be deemed by Sponsor
as proof of entry. Any attempted form of entry into this Promotion other than
as described herein is void.

3. Prizes/Odds of Winning. There are four (4) prizes for each individual
nonconnective sweepstakes / Eligible City. Each prize consists of:
A ticket for winner and one (1) guest to the premiere of the movie
American Hardcore (“Premiere”) and the immediately following after-party
(“Party’) at a location designated by Sponsor in the winner’s
respective Eligible City (Premiere and Party are currently scheduled
to occur in mid to late September in Los Angeles and New York AND in October
for Boston
and San Francisco). Prize also includes roundtrip ground transportation
to and from winner’s residence and the Premiere and Party (maximum of
50 miles from premiers), the opportunity for winner to videotape the Premiere
and Party (winner is NOT allowed to videotape within the THEATER
HOSTING THE
PREMIERE) (COLLECTIVELY, “FOOTAGE”) AND THE POSSIBILITY TO HAVE
SUCH FOOTAGE UPLOADED TO SPONSOR’S WEB PAGE ON THE YOUTUBE WEB SITE.
APPROXIMATE RETAIL VALUE (“ARV”) OF EACH PRIZE: $450. ODDS
OF WINNING A PRIZE FOR A PARTICULAR INDIVIDUAL NONCONNECTIVE SWEEPSTAKES DEPEND
ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED FOR THAT PARTICULAR
INDIVIDUAL
NONCONNECTIVE SWEEPSTAKES. EACH WINNER MUST USE PRIZE ON DATE AND
TIME SPECIFIED BY SPONSOR AT ITS SOLE DISCRETION OR SUCH WINNER WILL BE DISQUALIFIED

AN ALTERNATE WINNER MAY BE SELECTED AT SPONSOR’S SOLE DISCRETION. IN
ORDER TO VIDEOTAPE THE PREMIERE AND/OR PARTY, EACH WINNER IS RESPONSIBLE FOR
PROVIDING HIS/HER OWN VIDEO CAMERA AND MEDIA STORAGE DEVICE. IN ORDER FOR
A WINNER’S FOOTAGE TO BE CONSIDERED FOR DISPLAY ON SPONSOR’S WEB
PAGE ON THE YOUTUBE WEB SITE, SUCH WINNER MUST ENSURE THAT HIS/HER FOOTAGE
MEETS THE CONDITIONS AND RESTRICTIONS FOR A VIDEO TO BE POSTED ON THE YOUTUBE
WEB SITE WHICH ARE AVAILABLE AT HTTP://WWW.YOUTUBE.COM/T/HELP_CENTER WHICH
IS MADE A PART OF THESE OFFICIAL RULES AND INCORPORATED HEREIN BY REFERENCE.
IT IS THE RESPONSIBILITY OF WINNERS TO REVIEW THOSE CONDITIONS AND RESTRICTIONS
LISTED ON THE AFOREMENTIONED WEB PAGE TO DETERMINE THE ELIGIBILITY OF THEIR
FOOTAGE FOR DISPLAY. IN ADDITION, ALL FOOTAGE IS SUBJECT TO YOUTUBE’S

USED BY WINNERS MUST BE HANDHELD AND WITH NO SUPPLEMENTAL LIGHTING. IF PREMIERE
AND/OR PARTY IS CANCELLED OR POSTPONED FOR ANY REASON, SUCH PORTION OF THE
PRIZE WILL BE FORFEITED AND NO ADDITIONAL SUBSTITUTE PRIZE OR COMPENSATION
WILL BE PROVIDED IN LIEU THEREOF. TICKETS TO PREMIERE AND PARTY ARE FOR ADMISSION
ONLY. WINNERS AND GUEST MAY BE PROVIDED WITH A CHAPERONE FOR THE PREMIERE
AND/OR PARTY. WINNERS’ OPPORTUNITY TO VIDEOTAPE AT THE PREMIERE AND/OR
PARTY DOES NOT GUARANTEE ACCESS TO INTERVIEW ATTENDEES. SPONSOR RESERVES THE
RIGHT IN ITS SOLE DISCRETION TO MAKE ANY CHANGES TO THE PREMIERE AND/OR PARTY
LOCATION AND SHALL NOT INCUR ANY LIABILITY RESULTING FROM ANY SUCH CHANGES.
WINNERS MAY BE SUBJECT TO CERTAIN REQUIREMENTS (E.G., ATTIRE, BEHAVIOR) AND
GUIDELINES (E.G., APPROPRIATE VIDEOTAPING TECHNIQUE) PROVIDED BY Sponsor at
its sole discretion in order to appear at the Premiere and/or Party and videotape
the events, such additional requirements being incorporated herein by reference.
Videotaping or behavior at the Premiere and/or Party that violates these requirements
or the instructions of Sponsor’s representatives, as determined by Sponsor
or Sponsor’s representative, in the sole discretion of either, will
forfeit such winner’s participation in the Premiere elements of his/her
prize. Winners may be required to complete additional documentation prior
to attending Premiere and/or Party. Each winner is responsible for ensuring
that his/her Footage does not include material unfit for publication, objectionable
material, material that defames or invades the publicity or privacy rights
of any person, living or deceased, or otherwise infringe upon any third party’s
personal or proprietary rights. Prize subject to ground transportation availability,
Premiere and Party conditions and restrictions, and all other prize restrictions.
Guest of each winner must be 21 years of age or older at time of completion
of Guest Release (described below). Each winner and his/her guest must travel
together on the same ground transportation. Trip winner is responsible for
all other incidentals/expenses not specifically mentioned as being included,
including but not limited to additional ground transportation, meals, gratuities,
and concessions. Each winner and his/her guest are solely responsible for
providing all necessary and required prize documentation. If a winner elects
to partake in prize without a guest, no additional compensations will be awarded.
All ground transportation service to be selected by Sponsor in its sole discretion.
Sponsor will not replace any lost or stolen tickets or other items provided
by Sponsor for this prize. No transfer, substitution or cash equivalent for
a prize (or component of a prize) will be offered, except that Sponsor, at
its sole discretion, may substitute a prize (or any element thereof) for a
prize of equal or greater value, whether due to prize unavailability, or for
any other reason. Any depictions of prize are for illustrative purposes only.
All federal, state, or other taxes (if applicable) are the sole responsibility
of the winners. Limit one (1) prize per person/family/household. By participating
in any Premiere component of this prize, each winner and his/her guest agrees
to be taped and/or photographed. While Sponsor will seek to accurately present
each winner’s Footage on the Web Site (described below), Sponsor has
the right to modify, edit, adapt, and electronically alter the Footage without
compensation or further notice to winners. As determined by Sponsor in its
sole discretion, any part of the Footage that includes material unfit for
publication, objectionable material, material that defames or invades the
publicity or privacy rights of any person, living or deceased, or otherwise
infringe upon any third party’s personal or proprietary rights will
be disqualified or the whole Footage altogether. If a winner’s Footage
is displayed on the YouTube web site, no compensation will be awarded.
4. Drawing and Notification of Winners: For each individual
nonconnective sweepstakes, four (4) potential winners will be randomly selected
from all eligible Entries received for that particular individual nonconnective
sweepstakes in a drawing held on or about the Drawing Date (see Chart) for
that particular individual nonconnective sweepstakes by Sponsor. Potential
winners will be notified by phone (at the phone number provided on that entrant’s
Entry) within two (2) days of the Drawing Date. If a potential winner cannot
be reached after a reasonable effort has been exerted, he/she is found to
be ineligible, he/she cannot or does not comply with these Official Rules,
and/or if his/her prize or prize notification is returned as undeliverable,
such potential winner will be disqualified and, if applicable, an alternate
potential winner of such prize will be selected at Sponsor’s sole discretion.
5. General Conditions: This Promotion is subject to these
Official Rules and all federal, state and local laws and regulations
(collectively “Rules
and Laws”). Each potential winner will be required to sign, execute,
have notarized, and return an Affidavit of Eligibility, a Liability
Release, a Publicity Release (where legal), and any other documentation that
the Sponsor
may require (collectively “Affidavit/Release”), within two (2)
days after receipt, or such potential winner will be disqualified,
and an alternate potential winner may be selected at Sponsor’s sole
discretion. Guest of each winner will be required to sign, execute, have notarized,
and
return a Liability Release, a Publicity Release (where legal), and
any other documentation that the Sponsor may require, within two (2) days
after receipt.
A fax copy of a winner's Affidavit/Release and Guest Release, and
a copy of a government issued, photo identification from both may be requested
(at Sponsor’s
sole discretion) and such fax copy will have the same force and effect
as the original documents. By returning a completed Affidavit/Release, such
winner
attests to the authenticity of his/her winning Entry and the provisions
stated therein including compliance with these Official Rules. Also, by returning
a complete Affidavit/Release, each winner acknowledges and agrees
that his/her
Footage may be displayed on (or accessible from) the YouTube web
site. Once submitted, Entries and the corresponding Entry Information become
the sole
property of Sponsor and will not be returned. Entrants may receive
future promotional information from Sponsor. Any personal information supplied
by
entrants to Sponsor or its affiliates will be subject to Sponsor’s privacy
policy located at: (http://www.sonypictures.com/corp/privacy.html).
Except where prohibited by law and/or Sponsor’s privacy policy (as applicable),
entry into the Promotion and/or a winner’s acceptance of a prize constitutes
permission of such winner for Promotion Entities to: 1) use, without
notice or further compensation, worldwide, and in perpetuity, in any and all
forms
of media, now known and hereafter devised, including, without limitation,
on the Web Site, winner’s first name, last initial, city, state, and
Footage for purposes of advertising, trade, promotion and publicity;
2) modify, use, assign and/or dispose of Entries however it sees fit and for
any purpose
without any notice or compensation to entrant or any third parties.
Additionally, if an entrant chooses to opt-in to a specific offer from a participating
Promotion
Entity, his/her personal information will be subject to that Promotion
Entity's privacy policy and terms of service (if applicable), and such entrant
agrees
to receive additional email communication from that Promotion Entity.
Respective privacy policies of Promotion Entities participating in opt-ins
will be accessible
from Promotion entry page. Sponsor is in no way responsible for such
independent offers from Promotion Entities. Sponsor reserves the right, at
its sole discretion,
to disqualify any individual it finds to be tampering with the entry
process or the operation of Promotion, or the Web site promoting the Promotion;
to
be acting in violation of the Official Rules; or to be acting in
a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse,
threaten or harass any
other person. Any person attempting to defraud or in any way tamper
with Promotion will be ineligible to win a prize and will be prosecuted to
the full extent
of the law. If, for any reason, Promotion is not capable of running
as originally planned, Sponsor, at its sole discretion, reserves the right
to cancel, suspend
or modify Promotion thereof and conduct any or all of the drawings
from all eligible Entries received for that individual nonconnective sweepstakes
or
all individual nonconnective sweepstakes prior to and/or after (as
appropriate) the action taken by Sponsor. In case of a dispute over the identity
of the
entrant who submitted a winning Entry, the authorized account holder
of the email address associated with that Entry will be deemed the entrant.
The "authorized
account holder" is deemed the natural person who is assigned to an email
address by an Internet access provider, service provider or other
online organization that is responsible for assigning e-mail addresses for
the domain associated
with the submitted email address. Said entrant must comply with these
Official Rules and, at Sponsor’s sole discretion, may be required to
provide proof of ownership of the email account.
6. Disclaimers: Promotion Entities are not responsible or
liable for Entries that are entered by other than human means (such as by
any non-human mechanism, entity, or device), or for Entries that are illegible,
late, destroyed, lost, misplaced, stolen, forged, misdirected, tampered with,
incomplete, damaged, or otherwise not in compliance with these Official Rules
and all such Entries will be disqualified. By entering Promotion, each entrant
agrees and acknowledges to be bound by the Rules and Laws, as well as the
decisions of Sponsor which are final and binding in all respects; to waive
any rights to claim ambiguity with the Rules and Laws, and that Promotion
Entities shall have no responsibility or liability (including, but not limited
to, liability for any property loss, damage, personal injury or death) in
connection with: participation in this Promotion (including, but not limited
to, a winner’s Footage not being posted on the YouTube web site or associated
Web pages); third party claims of ownership to Footage, third party claims
of infringing use by any of the Sweepstakes Entities of Footage; acceptance/possession,
defects, and/or use/misuse of any prize (including, but not limited to a winner’s
use of his/her video camera and storage media device while using the prize
won); winners’ Footage if posted or displayed in any media; cancellations
and/or delays or any change by any company or any other persons providing
any prize component due to reasons beyond Sponsor’s control; human error;
incorrect or inaccurate transcription of Entry Information; any technical
malfunctions of the telephone network, computer online system, computer equipment,
software, or internet service provider utilized by Promotion; interruption
or inability to access web pages associated with the Promotion, or any online
service via the internet due to hardware or software compatibility problems;
any damage to entrant’s (or any third person’s) computer and/or
its contents related to or resulting from any part of Promotion; cancellations
and/or delays or any change of the Premiere and/or Party due to reasons beyond
Sponsor and/or Promotion Entities control, and/or any other errors or malfunctions,
even if caused by the negligence of one of the Promotion Entities. Each entrant
further agrees to indemnify and hold harmless Promotion Entities from any
and all liability resulting or arising from Promotion and to release all rights
to bring any claim, action or proceeding against Promotion Entities. Promotion
Entities shall not be liable for any injury, damage, loss, expense, accident,
delay, inconvenience or irregularity that may be caused or contributed to
(1) by any wrongful, negligent or unauthorized act or omission on the part
of a prize supplier or any of its agents, servants, employees or independent
contractors, (2) by any wrongful, negligent or unauthorized act or omission
on the part of any other person or entity not an employee of Sponsor, or (3)
by any other cause, condition or event whatsoever beyond the control of Sponsor
or its parents, subsidiaries and affiliated companies.
7. Ownership of Footage: Except as specifically provided for herein,
each winner who provides his/her Footage for the opportunity to be
displayed on the YouTube web site agrees and understands that his/her Footage
was commissioned
hereunder on a "work made for hire" basis as between such winner
and Sponsor and one hundred percent (100%) of the copyright throughout the
universe in perpetuity in and to all results and proceeds, if any, of such
winner’s Footage hereunder shall be owned and controlled by Sponsor
and those acting under its authority including, the right to use the Footage
throughout the universe, in whole or in part, in edited, unedited or distorted
form, on and in connection with this Sweepstakes, for any trade, advertising
or promotional purposes whatsoever, without notice, review, approval, notification
or payment from or to any person or entity, including without limitation any
company entitled to a winner’s exclusive performing services or any
other rights with respect to a winner’s performing services, or any
union or guild if applicable, in all media now known or hereafter discovered
throughout the universe. Sponsor has the right to modify, edit, adapt, and
electronically alter Footage as well as reproduce it/them, in whole or in
part, at any time without compensation or further notice to such winner. If
Footage is not deemed a “work made for hire” under copyright law,
such winner unconditionally assigns and transfers all ideas, concepts, copyrighted
materials and trademarks contained in the Footage and other items of the entry
materials and any and all rights including “moral rights” in the
Footage and other items in the entry materials to the Sponsor. Sponsor
has the right to use, assign or dispose of Footage and any other items of
the
entry materials however it sees fit without notice to, approval of
or compensation to, the winners or any third party.
8. Rules/Winners List: For a copy of these Official Rules or the
Winners List, send a self-addressed, stamped envelope to: American
Hardcore Premiere Sweepstakes "Rules" or "Winners
List" (specify
which), P.O. Box 6493, Burbank, CA 91510. All requests must be received
by December 1, 2006. The Official Rules will be accessible from the Web Site
during the Promotion Period. The Winners List may be posted on the
Web Site.
