THIS SWEEPSTAKES IS OFFERED ONLY IN THE 50 STATES OF THE U.S. AND D.C., AND IS INTENDED FOR PARTICIPATION IN THOSE AREAS ONLY. PLEASE DO NOT PROCEED IF YOU ARE NOT A LEGAL RESIDENT OF ONE OF THOSE AREAS AND 18 YEARS OF AGE OR OLDER AS OF DECEMBER 15, 2005.

  1. Eligibility: This Sweepstakes is open only to legal residents of the 50 states of the U.S. and the District of Columbia, who are physically located and residing therein, who are 18 years of age or older as of December 15, 2005. Employees of Sony Pictures Classics, Inc. ("Sponsor"), Sony Pictures Entertainment Inc., MTV Networks, a division of Viacom International Inc., Skycastle Entertainment, Inc., Sullivan Compliance Company ("Sweepstakes Administrator"), their advertising or promotion agencies, those involved in the production, development, implementation or handling of this Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, affiliates, licensees, service providers, prize suppliers, any other person or entity associated with this Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (spouses, children, siblings, parents), and/or persons living in the same household as such persons, whether or not related, are ineligible to enter this Sweepstakes.
  2. How to Enter: The Breakfast on Pluto Sweepstakes ("Sweepstakes") begins at 12:00:01 a.m. Eastern Time ("ET") on December 15, 2005 and ends at 11:59:59 p.m. ET on January 15, 2006 ("Sweepstakes Period"). You can enter online or by mail. To enter online, access www.breakfastonplutofilm.com ("Web Site") and follow the online instructions to complete and thereafter submit the Sweepstakes entry form ("Online Entry"). Information required on the entry form consists of your First Name, Last Name, Address (no P.O. Boxes), City, State, Zip, Daytime Telephone Number (including area code), Email Address, Date of Birth, and Gender (collectively "Entry Information"). Limit one (1) Online Entry per person/email address/calendar day. Online Entries by the same person in excess of this limit will be disqualified. Online Entries must be received by 11:59:59 p.m. ET on January 15, 2006. To enter by mail, legibly handprint your Entry Information (email address optional) on a postcard (no larger than 5" x 7") enclosed in a postage-paid business size envelope (#10) and mail it to: Breakfast on Pluto Sweepstakes, P.O. Box 10877, Burbank, CA 91510 ("Mail Entry"). Mail Entries must be mailed separately, postmarked by January 17, 2005 and received by January 20, 2006. All Entry Information for Online Entries and Mail Entries (collectively, "Sweepstakes Entries") must be completed in full. No copies, facsimiles, or reproductions of Mail Entries will be accepted. Proof of delivery or receipt of a Sweepstakes Entry will not be deemed by Sponsor as proof of entry. Any attempted form of entry into this Sweepstakes other than as described herein is void.
  3. Prizes/Odds of Winning. One (1) Grand Prize: Grand Prize consists of one (1) set of the entire Sony Pictures Classic library on DVD (approximately 200 DVDs) including Breakfast on Pluto (when it becomes available on DVD) ("DVD Library"). Approximate Retail Value "(ARV") is: $6,000); and one (1) official Breakfast on Pluto gift pack consisting of an official movie poster, soundtrack and novel ("Breakfast on Pluto Gift Pack") (ARV: $45). Total ARV of Grand Prize: $6,045. Contents of DVD Library subject to availability and will include those titles active and in stock at time of prize fulfillment. Five (5) First Prizes: Each First Prize consists of one (1) Breakfast on Pluto DVD (when available) and a Breakfast with Pluto Gift Pack. ARV of each First Prize: $75. Ten (10) Second Prizes: Each Second Prize consists of one (1) Breakfast on Pluto movie poster. ARV of each Second Prize: $10. Total ARV of all Prizes: $6,520. Odds of winning a prize depends on the number of eligible Entries received. DVDs will not be exchanged for movie titles in different formats. DVD prizes do not include a DVD player. No transfer, substitution or cash equivalent for a prize (or component of a prize), except that Sponsor, at its sole discretion, may substitute a prize (or any element thereof) for a prize of equal or greater value, whether due to prize unavailability, or for any other reason. Any depictions of prizes are for illustrative purposes only. Winners are solely responsible for all costs, incidentals, and any other expenses not specifically mentioned as being included. All federal, state, or other taxes (if applicable) are the sole responsibility of the winners. Prizes will be shipped/mailed to addresses within the 50 states of the U.S. and D.C. only. Limit one (1) prize per person/family/household. Grand Prize winner will receive an IRS Form 1099 from the Sponsor for the total ARV of the Grand Prize stated above.
  4. Drawing and Notification of Winners: Potential winners will be randomly selected from all eligible Sweepstakes Entries received in a drawing held on or about January 27, 2006 ("Drawing Date") by Sweepstakes Administrator, an independent judging organization. Potential Grand Prize winner will be notified by phone (at the phone number provided on that entrant's Sweepstakes Entry) within two (2) weeks of the Drawing Date. All other potential winners will be notified by mail within one (1) month of the Drawing Date. If a potential winner cannot be reached after a reasonable effort has been exerted, he/she is found to be ineligible, he/she cannot or does not comply with these Official Rules, and/or if his/her prize or prize notification is returned as undeliverable, such potential winner will be disqualified and, if applicable, an alternate potential winner of such prize will be selected at Sponsor's sole discretion.
  5. General Conditions: This Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). If a winner is a resident of a state that deems him/her to be a minor, prize will be awarded in the name of his/her parent/legal guardian. Potential Grand Prize winner (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal), and any other documentation that the Sweepstakes Administrator and/or Sponsor may require (collectively "Affidavit/Release"), within five (5) days after receipt, or such potential Grand Prize winner will be disqualified, and an alternate potential Grand Prize winner may be selected at Sponsor's sole discretion. By returning a completed Affidavit/Release, Grand Prize winner attests to the provisions stated therein including compliance with these Official Rules. Once submitted, Sweepstakes Entries and the corresponding Entry Information become the sole property of Sponsor and will not be returned. Entrants may receive future promotional information from Sponsor. Any personal information supplied by entrants to Sponsor or its affiliates online will be subject to Sponsor's privacy policy located at: (http://www.sonypictures.com/corp/privacy.html). Except where prohibited by law and Sponsor's privacy policy (as applicable), entry into the Sweepstakes and/or a winner's (winner's parent/legal guardian, if winner is a minor) acceptance of a prize constitutes permission of such winner for Sponsor to: 1) use, without notice or further compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, on the Web Site, winner's first name, last initial, city and state for purposes of advertising, trade, promotion and publicity; 2) modify, use, assign and/or dispose of Sweepstakes Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Additionally, if an entrant chooses to opt-in to a specific offer from a participating Sweepstakes Entity, his/her personal information will be subject to that Sweepstakes Entity's privacy policy and terms of service (if applicable), and such entrant agrees to receive additional email communication from that Sweepstakes Entity. Respective privacy policies of Sweepstakes Entities participating in opt-ins will be accessible from Sweepstakes entry page. Sponsor is in no way responsible for such independent offers from Sweepstakes Entities. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of Sweepstakes, or the Web site promoting the Sweepstakes; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any person attempting to defraud or in any way tamper with Sweepstakes will be ineligible to win a prize and will be prosecuted to the full extent of the law. If, for any reason, Sweepstakes is not capable of running as originally planned, Sponsor, at its sole discretion, reserves the right to cancel, suspend or modify Sweepstakes thereof and conduct the drawing from all eligible Sweepstakes Entries received prior to and/or after (as appropriate) the action taken by Sponsor. In case of a dispute over the identity of the entrant who submitted a winning Online Entry, the authorized account holder of the email address associated with that Online Entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted email address. Said entrant must comply with these Official Rules and, at Sponsor's sole discretion, may be required to provide proof of ownership of the email account.
  6. Disclaimers: Sweepstakes Entities are not responsible or liable for Sweepstakes Entries that are entered by other than human means (such as by any non-human mechanism, entity, or device), or for Entries that are illegible, late, destroyed, lost, misplaced, stolen, mutilated, forged, misdirected, tampered with, incomplete, damaged, mechanically duplicated and mass machine printed, postage-due Mail Entries or otherwise not in compliance with these Official Rules and all such Sweepstakes Entries will be disqualified. By entering Sweepstakes, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sweepstakes Administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in Sweepstakes; acceptance/possession, defects, and/or use/misuse of any prize; cancellations and/or delays or any change by any company or any other persons providing any prize component due to reasons beyond Sponsor's control; shipping delays for any prize or prize component; human error; incorrect or inaccurate transcription of Entry Information; any technical malfunctions of the telephone network, computer online system, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access web pages associated with the Sweepstakes, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of Sweepstakes; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Each entrant further agrees to indemnify and hold harmless Sweepstakes Entities from any and all liability resulting or arising from Sweepstakes and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of a prize supplier or any of its agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sponsor, or (3) by any other cause, condition or event whatsoever beyond the control of Sponsor or its parents, subsidiaries and affiliated companies.
  7. Rules/Winners List: For a copy of these Official Rules or the Winners List, send a self-addressed, stamped envelope to: Breakfast on Pluto Sweepstakes "Rules"/"Winners List" (specify which), P.O. Box 6375, Burbank, CA 91510. All requests must be received by March 15, 2006. The Official Rules will be accessible from the Web Site during the Sweepstakes Period. The Winners List may be posted on the Web Site.
