THIS SWEEPSTAKES IS OFFERED ONLY IN THE 48 CONTIGUOUS STATES OF THE UNITED STATES ("U.S.") (ALASKA AND HAWAII ARE EXCLUDED) AND THE DISTRICT OF COLUMBIA ("D.C."), AND IS INTENDED FOR PARTICIPATION IN THOSE AREAS ONLY. THIS SWEEPSTAKES SHALL BE CONSTRUED AND GOVERNED ACCORDING TO THE LAWS OF THE U.S. PLEASE DO NOT PROCEED IF YOU ARE NOT 18 YEARS OF AGE OR OLDER AS OF AUGUST 1, 2007 AND A CURRENT LEGAL RESIDENT OF ONE OF THE 48 CONTIGUOUS STATES OF THE U.S. (AK AND HI ARE EXCLUDED) OR D.C.

  1. Eligibility: The Jane Austen Book Club Sweepstakes ("Sweepstakes") is open only to current legal residents of the 48 contiguous states of the U.S. (Alaska and Hawaii are excluded) and D.C., who are physically located and residing therein, and who are 18 years of age or older as of August 1, 2007. If a person is a resident of a jurisdiction that deems him/her to be a minor, he/she must obtain parental/legal guardian consent prior to submitting any personally identifiable information. Any individuals who have, within the last six months, held employment with or performed services for Sony Pictures Classics Inc. ("Sponsor"), Sony Pictures Entertainment Inc., Penguin Group (USA) Inc., Plume Books, Pathfinders, the Jane Austen Society of North America, Inc., Sweepstakes administrator, their advertising or promotion agencies, those involved in the production, design, printing, development, implementation or handling of the Sweepstakes, any agents acting for, or on behalf of the above entities, their respective parent, subsidiary, and related companies, officers, directors, subsidiaries, affiliates, licensees, service providers, any other person or entity associated with the Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (spouses, children, siblings, parents), and/or persons living in the same household as such persons, whether or not related, are ineligible to participate in the Sweepstakes.
  2. Sweepstakes Description: The Sweepstakes begins at 12:00:01 a.m. Eastern Time ("ET") on August 1, 2007, and ends at 11:59:59 p.m. ET on November 1, 2007 ("Sweepstakes Period"). Eastern Time shall control for all purposes of the Sweepstakes. Sponsor shall control the official clock for all purposes of the Sweepstakes.
  3. How to Enter: You can enter online or by mail. To enter online, access the Sweepstakes web page located at www.thejaneaustenbookclubmovie.com ("Web Site"). Then, follow the online instructions to complete (and thereafter submit) the Sweepstakes entry form ("Online Entry"). Information required on the entry form consists of your First Name, Last Name, Street Address (no P.O. Boxes), City, State, Zip Code, Date of Birth, Phone Number (including area code), and Email Address (collectively, "Entry Information"). Online entries must be received by 11:59:59 p.m. ET on November 1, 2007. To enter by mail without completing the Online Entry form, legibly handprint your Entry Information (email address optional), on a standard sized postcard (no larger than 5" x 7"), enclose it in a postage-paid business size envelope (#10), and mail it to: The Jane Austen Book Club Sweepstakes, P.O. Box 6807, Burbank, CA 91510 ("Mail Entry"). No copies, facsimiles, or reproductions of Mail Entries will be accepted. Mail Entries must be postmarked by November 1, 2007 and received by November 7, 2007. For Online Entry and Mail Entry (collectively, "Sweepstakes Entry"), all required Entry Information must be completed in full. Proof of delivery or receipt of a Sweepstakes Entry will not be deemed by Sponsor as proof of entry. Any attempted form of entry into this Sweepstakes other than as described herein is void. Limit one (1) Sweepstakes Entry per person/email address/home address regardless of the method of entry for the entire Sweepstakes. Sweepstakes Entries by the same person in excess of this limit will be disqualified.
  4. Prizes / Odds of Winning. One (1) Grand Prize: Trip for two (2) to the 2008 Jane Austen Tour in England ("Tour"). Trip consists of: round-trip, coach class air transportation for Grand Prize winner and one (1) guest from a major commercial airport (as determined by Sponsor in its sole discretion) near Grand Prize winner's residence in the 48 contiguous states of the U.S. or D.C. to England (exact fight details and airport destination to be determined by Sponsor at its sole discretion); standard hotel accommodations for (2) people (single room/double occupancy) for the Tour; non-exclusive ground transportation for Grand Prize winner and guest to and from the airport while in England and to all tour destinations; Tour will include breakfast daily, select luncheons, and select dinners in historic settings (exact restaurants to be determined by Sponsor in its sole discretion; alcohol not included; a British guide specializing in Austen and her era will accompany the Tour. The Tour will include an itinerary that will center on Jane Austen's homes and places she visited, including Steventon, Bath, Chawton, Winchester, and London. Approximate Retail Value ("ARV") of trip component: $9,500.00. Grand Prize winner will also receive: one (1) set of Jane Austen Books from Penguin/Plume and one (1) Jane Austen prize pack consisting of an official movie poster and Jane Austen mug (ARV: $160.00). Total ARV of Grand Prize: $9,660.00. ARV for the Grand Prize varies depending upon the point of departure, fare fluctuation, and number of travelers, any differences between the ARV and the actual value will not be awarded. Trip prize conditions: Sponsor reserves the right to award the air transportation "as is" and to structure travel route in its sole discretion. The destination may not be exchanged for another destination. WINNER AND GUEST MUST BE ABLE TO TAKE TRIP DEPARTING ON DATES AND TIMES SPECIFIED BY SPONSOR AT ITS SOLE DISCRETION TO ATTEND THE 2008 JANE AUSTEN TOUR (CURRENTLY ANTICIPATED TO BE IN AUGUST OR SEPTEMBER 2008 (EXACT DATES TO BE DETERMINED BY SPONSOR IN ITS SOLE DISCRETION)) OR SUCH WINNER WILL BE DISQUALIFIED AND AN ALTERNATE POTENTIAL WINNER MAY BE SELECTED AT SPONSOR'S SOLE DISCRETION. Trip is subject to air/ground travel availability, hotel availability, and is subject to the specific terms and conditions set forth by travel prize suppliers and Sponsor. Once trip dates have been booked, no change, extension or substitution of trip dates is permitted, except at Sponsor's sole discretion. Grand Prize winner or his/her guest must present at least one major credit card in good standing in order to check into room(s). No refund or replacement of travel arrangements/bookings will be considered for any missed prize features, nor for any consequences of no-show at stipulated times or places nor expiration of trip. If Grand Prize winner elects to partake in the travel prize without any guest, then the remaining elements of the trip prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. Grand Prize winner and his/her guest must travel together on the same itinerary. If a component of the Grand Prize is not available during time of Grand Prize winner's trip for whatever reason (e.g., weather conditions, etc.), that portion of the Grand Prize will be forfeited, and no compensation will be awarded in lieu thereof. If Tour is cancelled or postponed prior to booking, each winner will have six (6) months from date of notification of winning to take trip without the Tour portion of the prize and must give at least 30 days advance notice of selected travel date. Items not specifically mentioned as being included as part of the Grand Prize are the sole responsibility of the Grand Prize winner and his/her guest(s), if applicable, and may include, but are not limited to, unspecified ground transportation, airport tax, travel tax, travel insurance, room service, laundry service, spa treatments, meals, hotel incidentals, local and long distance telephone calls, gratuities, personal items, government fees, and all other costs and expenses not otherwise mentioned herein. If Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must make his/her own travel arrangements and pay his/her own expenses unless deemed to be the travel guests. If a travel guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must make his/her own travel arrangements and pay his/her own expenses unless deemed to be the Grand Prize winner. Grand Prize winner and his/her guest are solely responsible for providing and holding all necessary identification documents and travel documents (e.g. Passport, visa and I.D's). Failure to provide such documents may result in trip cancellation upon airport check-in. Five (5) First Prizes: one (1) set of Jane Austen Books from Penguin/Plume and one (1) Jane Austen prize pack consisting of an official movie poster and Jane Austen mug. (ARV: $160.00). Total ARV of First Prizes: $800.00. Ten (10) Second Prizes: One official Jane Austen movie poster. (ARV: $10). Total ARV of Second Prizes: $100.00. Odds of winning a prize depend on the total number of eligible Sweepstakes Entries received. TOTAL ARV OF ALL PRIZES IS $10,560.00. All applicable federal, state, and local taxes on the prizes are the sole responsibility of each winner. No substitution, transfer, or redemption of any prize (or any element of any prize) for cash is permitted. Any depictions of the prizes, in promotional materials or otherwise, are for illustrative purposes only. The Grand Prize winner will receive an IRS Form 1099 for the year in which their prize was won and awarded from the Sponsor for the total ARV noted in these Official Rules. Prize notifications and prize merchandise will be mailed/shipped to addresses within the 48 contiguous states of the U.S. and D.C. only. Sweepstakes administrator is not the supplier or guarantor of any prize. Limit one (1) prize per person/family/household.
  5. Drawing and Notification/Verification. All winners will be randomly selected from all eligible Sweepstakes Entries received in a drawing to be held on or about November 15, 2007 by Sweepstakes administrator, an independent judging organization ("Drawing Date"). Potential Grand Prize winner will be notified by phone within three (3) days of the Drawing Date. All other potential winners will be notified by mail within one (1) month of the Drawing Date. If a potential winner cannot be reached after a reasonable effort has been exerted, he/she is found to be ineligible, he/she cannot or does not comply with these Official Rules, and/or if his/her prize or prize notification is returned as undeliverable, such potential winner will be disqualified and, if applicable, an alternate potential winner of such prize will be selected at Sponsor's sole discretion.
  6. General Conditions: This Sweepstakes is subject to these Official Rules and all federal, state and local laws and regulations (collectively "Rules and Laws"). Participants agree to be bound by the Rules and Laws, and the decisions of Sponsor, Sweepstakes administrator and/or Sponsor's representatives, which are final and binding in all respects, and waive any right to claim any ambiguity in these Official Rules or Sweepstakes materials. If a winner is a resident of a state that deems him/her to be a minor, such prize may be awarded in the name of his/her parent/legal guardian. The potential Grand Prize winner (or his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, a Publicity Release (where legal), and any other documentation that the Sweepstakes administrator and/or Sponsor may require (collectively "Affidavit/Release"), within five (5) days after receipt or such potential winner may be disqualified, and an alternate potential Grand Prize winner may be selected at Sponsor's sole discretion. Grand Prize winner's guest (or his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to sign, execute, have notarized, and return a Liability Release, a Publicity Release, and any other documentation that the Sweepstakes administrator and/or Sponsor may require (collectively "Guest Release"), within five (5) after Grand Prize winner's receipt of same. By returning a completed Affidavit/Release, Grand Prize winner attest to the provisions stated therein including compliance with these Official Rules. Submitting any information constitutes entrants' acceptance of the privacy policy and terms and conditions of Sponsor located at (http://www.sonypictures.com/corp/privacy.html). In addition, except where prohibited by law, the completion of an Affidavit/Release by the Grand Prize winner and, if applicable, Guest Release for Grand Prize winner's travel guest constitute permission of such winner and, if applicable, his/her travel guest (or his/her parent/legal guardian if winner or a guest is a resident of a jurisdiction that deems him/her to be a minor), as appropriate, for Sponsor, to use, without notice or compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, including, but not limited to, without limitation, such Grand Prize winner's and Grand Prize winner's travel guest's full name, city, state, likeness, voice, photos, videos, biographical information and statements made by such winner and his/her guest for purposes of advertising, trade, promotion and publicity. Once submitted, Sweepstakes Entries and the corresponding Entry Information become the sole property of Sponsor and will not be returned. Entrants may receive future promotional information from Sponsor. Additionally, by opting-in to companies' specific offers, participant's registration information will be subject to those companies' respective privacy policies and terms of service/terms of use (if any), and participant agrees to receive additional email communication from those companies. The privacy policy for any company participating in an opt-in will be accessible from the registration form. Opting in to specific offers does not improve one's chances of winning. Sponsor reserves the right, at its sole discretion, to disqualify from this Sweepstakes any individual it finds to be tampering with the entry process or the operation of Sweepstakes, or any web page associated with this Sweepstakes promoting the Sweepstakes; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any person attempting to defraud or in any way tamper with Sweepstakes will be ineligible to win a prize and will be prosecuted to the full extent of the law. If, for any reason, Sweepstakes is not capable of running as originally planned, Sponsor, at its sole discretion, reserves the right to cancel, suspend or modify Sweepstakes thereof and conduct any or all the drawings from all eligible Sweepstakes Entries received prior to and/or after (as appropriate) the action taken by Sponsor. Notice of such action by Sponsor will be provided in subsequent Sony communiqués.
  7. Disclaimers: Sweepstakes Entities are not responsible or liable for Sweepstakes Entries that are entered by other than human means (such as by any non-human mechanism, entity, or device), or for Entries that are illegible, late, destroyed, lost, misplaced, stolen, mutilated, forged, misdirected, tampered with, incomplete, damaged, mechanically duplicated and mass machine printed, postage-due Mail Entries or otherwise not in compliance with these Official Rules and all such Sweepstakes Entries will be disqualified. By entering Sweepstakes, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sweepstakes administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in Sweepstakes; acceptance/possession, defects, and/or use/misuse of any prize; cancellations and/or delays or any change by any company or any other persons providing any prize component due to reasons beyond Sponsor's control; shipping delays for any prize or prize component; human error; incorrect or inaccurate transcription of Entry Information; any technical malfunctions of the telephone network, computer online system, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access web pages associated with the Sweepstakes, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of Sweepstakes; cancellations and/or delays or any change by the air carrier(s), lodging facilities, or other company or any other persons providing any of components of the Grand Prize for the winner and his/her guest due to reasons beyond Sponsor and/or Sweepstakes Entities control, and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Each entrant further agrees to indemnify and hold harmless Sweepstakes Entities from any and all liability resulting or arising from Sweepstakes and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of a prize supplier or any of its agents, servants, employees or independent contractors, (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of Sponsor, or (3) by any other cause, condition or event whatsoever beyond the control of Sponsor or its parents, subsidiaries and affiliated companies.
  8.
